Terms of Use

Aeonis Storm (the “Service”) is operated by AEONIS LLC, a Florida limited liability company, 10001 NW 50th St #104, Sunrise, FL 33351 (“we”). By using the Service you agree to these terms.

1. What the Service is, and isn't

The Service shows hail and damaging wind reports from the NOAA Storm Prediction Center near a location, with distances, dates and sizes. It is for general information. It is not a property inspection, a damage assessment, an insurance determination, a forecast, or a weather warning. A storm report near a property does not mean the property was damaged, and the absence of reports does not mean it wasn't. For warnings and emergencies, follow the National Weather Service and local officials.

2. Data accuracy

Storm reports come from spotters, emergency managers, weather stations and the public. Locations are approximate (often to the nearest town or road), hail sizes are estimates, many storms go unreported, and preliminary reports can be corrected or removed before NOAA finalizes Storm Data. Distances are measured from geocoded points that can be off. We process the published files as described on our data page, but results can contain errors. Check important facts with the original source and an on-site inspection.

3. Acceptable use

Use the Service lawfully and honestly. In particular, you agree not to:

• tell a homeowner, insurer or anyone else that the Service shows their property was damaged, or present its output as an official NOAA or National Weather Service determination;
• use the Service in support of an insurance claim you know to be false or exaggerated;
• use it to market in ways that break the law, including telemarketing, text and robocall rules (such as the TCPA and do-not-call lists), email laws (CAN-SPAM), and local solicitation, door-to-door or contractor-licensing rules;
• use alarming or misleading claims about storm damage to pressure people;
• scrape, overload or resell the Service, or get around usage limits.

We may suspend access that violates these terms.

4. Updates by email

Leaving your email for Pro updates is free and creates no obligation. We'll use it only to tell you about Aeonis Storm, and you can unsubscribe anytime.

5. Aeonis Storm Pro (when offered)

Pro is a subscription sold through Gumroad, which acts as merchant of record. Plans, prices and limits are shown before purchase. Subscriptions renew automatically each month or year until you cancel. You can cancel anytime from your Gumroad receipt or library, and you keep access until the end of the paid period. Your license key is for you (Pro) or your team (Team) and shouldn't be shared publicly. Alert feed links are private to your account; anyone with a link can read that feed, so you can replace a link at any time.

6. Refunds

You can cancel anytime and keep access until the end of the paid period. We refund a first payment requested within 14 days, and any charge made in error. Requests: ronald@aeonis.pro.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS AND NON-INFRINGEMENT. ALERT FEEDS MAY BE DELAYED OR MISS STORMS AND ARE NOT A SAFETY SERVICE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AEONIS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSSES FROM RELYING ON THE SERVICE, INCLUDING INSURANCE, REPAIR, PURCHASE OR MARKETING DECISIONS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF YOU PAID NOTHING.

9. Indemnity

You agree to indemnify AEONIS LLC against claims arising from your misuse of the Service, including marketing you send, or your violation of these terms.

10. Governing law

Florida law governs these terms, without regard to conflict-of-law rules. Venue lies in the state or federal courts located in Broward County, Florida.
